How does validation work In Austria?

As Austria is the member of the European Patent Agreement, the European Patent can enjoy protection in Austria after the process of validation. Austria participates in the Unitary Patent system as well.

necessary documents: translation + Power of attorney

As the official language is German in Austria, if the B1 document is in German, you do not have to translate the documents. On the other hand, if the patent was granted with either an English or French description, a German translation of the description should be filed.

For filing the validation a signed Power of Attorney will be requested from the applicant. One of our colleagues will send you the form in email after ordering the validation in Austria. 

fees: official fee + service fee + translation fee

If the B1 document is in German, there is no official fee and translation fee.

If the B1 document is in English or French, the official fee is calculated based on the number of pages of the German translation. The official fee is EUR 166. The official fee increases by EUR 135 per 15 pages over 15 pages. Pages include the drawings and the claims as well. For example if the number of pages of the German translation is 40 pages, the official fee to be paid to the Austrian Patent Office will be 166+2*135=436 EUR.
