How does validation work In Germany?
As Germany is the member of the European Patent Agreement, the European Patent can enjoy protection in Germany after the process of validation. Germany participates in the Unitary Patent system as well.
Germany with the official language in common with one of the official languages of the EPO (German) will no longer require a translation of the patent specification in order to validate the granted patent in that country.
In Germany, there is no “validation” necessary, meaning that there is no need to file a translation or a request to validate the granted European patent. However, it is useful to file an address for service in these patent offices so that the applicant can be contacted if an issue arises, for example if an annuity payment was missed.
To file address for service in Germany there is no deadline. So, if you only need your patent to be valid in these countries, do not worry about the 3-month-long period.
