How does validation work In Luxembourg?

As Luxembourg is the member of the European Patent Agreement, the European Patent can enjoy protection in Luxembourg after the process of validation. Luxembourg participates in the Unitary Patent system as well.

Luxembourg with the official language in common with one of the official languages of the EPO (French) will no longer require a translation of the patent specification in order to validate the granted patent in that country.

In Luxembourg, there is no “validation” necessary, meaning that there is no need to file a translation or a request to validate the granted European patent. However, it is useful to file an address for service in these patent offices so that the applicant can be contacted if an issue arises, for example if an annuity payment was missed.

For filing the request a signed Power of Attorney will be requested from the applicant. One of our colleagues will send you the form in email after ordering the validation in Luxembourg. 

To file address for service in Luxembourg there is no deadline. So, if you only need your patent to be valid in these countries, do not worry about the 3-month-long period.
