How does patent renewal work In Austria?
Renewal fees are payable to the Austrian Patent Office in respect of national patent applications.
Whereas for a pending European patent application an applicant must pay a single maintenance fee at the EPO, after grant, during the term of the European patent, maintenance fees are payable to the national patent office, where the patent has been validated and is sought to be kept in force.
Austria participates in the Unitary Patent system as well. Annual renewal fees for Unitary Patents are paid to the EPO. Proprietors no longer need to pay national renewal fees in different currencies to multiple patent offices applying different legal requirements.
What is the deadline for renew a patent in Austria?
The annual fees are due each year on the last day of the application month.
For example if the application for the patent was submitted on September 9, 2013 and granted on May 8, 2019. The due date for the payment of the annual fee is September 31.
The annual fees may also be paid up to a maximum of six months after the due date. Payments made after the due date must include the annual fee plus a 20% surcharge.
For national patents, the annual fees must be paid after the patent is granted beginning with the sixth year (calculated from the last day of the application month).
For granted European patent applications, the first annual fee that must be paid to the Austrian Patent Office can be paid up to a maximum of 3 months after the due date without a 20% surcharge for payments made after the due date. After this, the first annual fee that must be paid to the Patent Office can be paid up to a maximum of another 9 months after that (i.e. up to a maximum of 12 months after the due date) including a 20% surcharge for payments made after the due date.
