How does patent renewal work In Malta?
Renewal fees are payable to the Malta Industrial Property Registration Directorate in respect of national patent applications.
Whereas for a pending European patent application an applicant must pay a single maintenance fee at the EPO, after grant, during the term of the European patent, maintenance fees are payable to the national patent office, where the patent has been validated and is sought to be kept in force.
Malta participates in the Unitary Patent system as well. Annual renewal fees for Unitary Patents are paid to the EPO. Proprietors no longer need to pay national renewal fees in different currencies to multiple patent offices applying different legal requirements.
What is the deadline for renew a patent in Malta?
The annual fees are due each year on the anniversary of date of filing.
For example if the application for the patent was submitted on October 9, 2012 and granted on May 8, 2019. The due date for the payment of the annual fee is October 9.
The annual fees are due after granting.
The annual fees may also be paid up to a maximum of six months after the due date. Payments made after the due date must include the annual fee plus a the following surcharge:
