How does patent renewal work In Slovakia?

Renewal fees are payable to the Industrial Property Office of Slovak The Republic in respect of national patent applications.

Whereas for a pending European patent application an applicant must pay a single maintenance fee at the EPO, after grant, during the term of the European patent, maintenance fees are payable to the national patent office, where the patent has been validated and is sought to be kept in force.

What is the deadline for renew a patent in Slovakia?

The annual fees are due each year on the anniversary of date of filing.

For example if the application for the patent was submitted on October 9, 2012 and granted on May 8, 2019. The due date for the payment of the annual fee is October 9.

The annual fees may also be paid up to a maximum of six months after the due date. Payments made after the due date must include the annual fee plus a 100% surcharge.

The annual payment of maintenance costs has to be paid for the first time for the first year of maintenance. The annuity payment is applicable before grant as well.

For European patents the first fee, due in the year in which the mention of the grant of the European patent is published in the European Patent Bulletin, must be paid

– on or before the anniversary of the date of filing,

or

– within 2 months of publication in the European Patent Bulletin of the mention of the grant of the European patent, whichever period expires later.
