How does patent renewal work In Switzerland?

Switzerland and Liechtenstein form a unified territory of protection. Consequently, a patent valid in Switzerland is also valid in Liechtenstein without further payments or administration.

Renewal fees are payable to the Swiss Federal Institute of Intellectual Property in respect of national patent applications.

Whereas for a pending European patent application an applicant must pay a single maintenance fee at the EPO, after grant, during the term of the European patent, maintenance fees are payable to the national patent office, where the patent has been validated and is sought to be kept in force.

What is the deadline for renew a patent in Switzerland?

The annual fees are due each year on the last day of the application month. You can pay the renewal fee in the first 3 months after the due date without surcharge, which is a big advantage compared to other countries. Annuity payment may not be made more than 2 months before due date.

For example if the application for the patent was submitted on October 9, 2012 and granted on May 8, 2019. The due date for the payment of the annual fee is October 31, however you can pay the renewal fee without a surcharge until January 31.

The annual fees have to be paid from the fourth year after the filing date.

The annual fees may also be paid up to a maximum of six months after the due date. Payments made 3 months after the due date must include the annual fee plus CHF 50 surcharge.
