How does patent renewal work In the United Kingdom?

Renewal fees are payable to the United Kingdom Intellectual Property Office in respect of national patent applications.

Whereas for a pending European patent application an applicant must pay a single maintenance fee at the EPO, after grant, during the term of the European patent, maintenance fees are payable to the national patent office, where the patent has been validated and is sought to be kept in force.

What is the deadline for renew a patent in the United Kingdom?

The annual fees are due each year on the last day of the application month. You can pay the renewal fee in the first month after the due date without surcharge.

For example if the application for the patent was submitted on October 9, 2012 and granted on May 8, 2019. The due date for the payment of the annual fee is October 31, however you can pay the renewal fee without a surcharge until November 31.

For European patents, where the date of publication in the European Patent Bulletin of the mention of grant of the patent occurs less than 3 months before an anniversary of the date of filing, the first renewal fee due on the patent following mention of grant may be paid up to the last day of the third whole calendar month after the date of publication in the Bulletin without any additional fee being charged.

The annual payment of maintenance costs has to be paid for the first time for the fifth year of maintenance.

The annual fees may also be paid up to a maximum of six months after the due date. Payments made 1 months after the due date must include the annual fee plus the following surcharge.
