European Patent Validation in Hungary After Grant: Deadlines, Translations and Portfolio Controls

For European patents granted in 2026, Hungary remains a separate post-grant decision. It is not covered by the current territorial scope of the Unitary Patent, so protection in Hungary requires national validation. The core filing can look straightforward, but language, deadline and renewal details can materially affect enforceability and portfolio value.

The short summary on European patent validation in Hungary

A European patent becomes effective in Hungary when the proprietor files the required translation with the Hungarian Intellectual Property Office (HIPO) and pays the prescribed publication fee within the applicable period. The ordinary deadline is three months from the date on which the mention of grant is published in the European Patent Bulletin.

Hungary has implemented the London Agreement, but it does not share an official language with the European Patent Office. The translation package therefore depends on the EPO language of proceedings:

·  If the patent was granted in English, the claims must be translated into Hungarian. A translation of the English description is not normally required for validation.

·  If the patent was granted in French or German, the claims must be translated into Hungarian and the remaining text must be supplied in English or Hungarian.

Why Hungary still needs separate validation when unitary effect is requested

The Unitary Patent currently covers 18 Member States. Hungary participates in the enhanced-cooperation framework but has not joined the states in which the Unified Patent Court Agreement is in force. It is therefore outside the territorial scope of Unitary Patents registered at that date.

The practical portfolio consequence is easy to miss. A proprietor may request unitary effect for the participating states and still need a conventional national validation in Hungary. Coverage of an individual Unitary Patent is fixed when unitary effect is registered; a later Hungarian accession would not retrospectively add Hungary to an existing Unitary Patent.

Hungary has signed the Unified Patent Court (UPC) Agreement but has shown no indication that it intends to ratify it. In 2015, the Ministry of Justice prepared legislation to ratify the agreement and amend related laws. However, the proposal was never submitted to Parliament because the government raised concerns about its compatibility with Hungary’s Constitution. On 26 June 2018, the Constitutional Court upheld those concerns, leaving ratification on hold pending further government action.

The three-month deadline and the late-filing window

The standard validation period runs for three months from publication of the mention of grant in the European Patent Bulletin. Hungarian law also provides a further three-month period in which the translation may be filed against payment of an additional fee. If the requirements are not met within the available periods, the European patent is deemed void in Hungary from the filing date.

That additional period should be treated as a recovery route, not a routine extension. Translation capacity, document formalities, authority to act and payment instructions should be settled against the ordinary deadline.

The same discipline is needed after opposition, limitation or amendment. When a European patent is maintained in amended form or limited, a fresh Hungarian translation requirement and deadline may arise. The post-grant file should therefore remain connected to the EPO proceeding rather than being treated as closed after initial validation.
